Abel Augusto Abelleira, responsible for the website, hereinafter RESPONSIBLE, makes this document available to users, with which they intend to comply with the obligations set forth in Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), as well as to inform all users of the website regarding its conditions of use.

Any person accessing this website assumes the role of user, committing to the observance and strict compliance with the provisions set forth herein, as well as any other applicable legal provision.

Abel Augusto Abelleira reserves the right to modify any type of information that may appear on the website, without any obligation to pre-advise or inform users of said obligations, it being understood as sufficient with the publication on the Meigas de Brigantia website.

Meigas de Brigantia will give such data the corresponding automated processing depending on its nature or purpose, in the terms indicated in the Privacy Policy section.

4. Industrial and Intellectual Property

The User acknowledges and agrees that all content shown on the Web Space is the exclusive property of Meigas de Brigantia and/or third parties, who have the exclusive right to use them in economic traffic. This specifically affects: designs, texts, images, logos, icons, buttons, software, commercial names, trademarks, or any other signs susceptible to industrial and/or commercial use, all trademarks, commercial names, or distinctive signs, which are subject to Intellectual Property rights. Additionally, any other industrial and intellectual property rights that may exist over the contents and/or any other elements inserted in the page are included. Therefore, the User agrees not to reproduce, copy, distribute, make available, or in any other way publicly communicate, transform, or modify such content, keeping Meigas de Brigantia harmless from any claim arising from the breach of such obligations. Under no circumstances does access to the Web Space imply any waiver, transmission, license, or total or partial transfer of such rights, unless explicitly stated otherwise.

These General Conditions of Use of the Web Space do not confer on Users any other right of use, alteration, exploitation, reproduction, distribution, or public communication of the Web Space and/or its Contents other than those expressly provided herein. Any other use or exploitation of any rights will be subject to the prior and express authorization specifically granted for that purpose by Meigas de Brigantia or the third-party holder of the affected rights.

The contents, texts, photographs, designs, logos, images, computer programs, source codes and, in general, any intellectual creation existing in this Space, as well as the Space itself as a whole, as a multimedia artistic work, are protected as copyright by the legislation on intellectual property. Meigas de Brigantia owns the elements that integrate the graphic design of the Web Space, the menus, navigation buttons, HTML code, texts, images, textures, graphics, and any other content of the Web Space or, in any case, has the corresponding authorization to use said elements. The content provided in the Web Space may not be reproduced in whole or in part, nor transmitted, nor registered by any information retrieval system, in any form or in any medium, unless prior written authorization is obtained from the aforementioned Entity.

Likewise, it is prohibited to delete, elude, and/or manipulate the "copyright" as well as the technical protection devices, or any information mechanisms that may contain the contents. The User of this Web Space agrees to respect the stated rights and to avoid any action that could harm them, with Meigas de Brigantia reserving the right in all cases to exercise all means or legal actions corresponding to it in defense of its legitimate intellectual and industrial property rights.

5. Obligations and Responsibilities of the Web Space User

The User agrees to:

Make appropriate and lawful use of the Web Space, as well as the content and services, in accordance with:

  1. the applicable legislation at all times;
  2. the General Conditions of Use of the Web Space;
  3. generally accepted morals and good customs, and
  4. public order.

Provide themselves with all the technical means and requirements necessary to access the Web Space.

Provide truthful information when filling out forms contained in the Web Space with personal data and keep them updated at all times so that they respond, at all times, to the User's actual situation. The User will be solely responsible for false or inaccurate statements made and the damages caused to Meigas de Brigantia or third parties by the information provided.

However, notwithstanding the provisions of the previous section, the User must also abstain from:

Making unauthorized or fraudulent use of the Web Space and/or its contents for illicit purposes or effects, prohibited in these General Conditions of Use, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate or prevent the normal use of services or documents, files and all kinds of content stored on any computer equipment.

Accessing or attempting to access restricted resources or areas of the Web Space, without meeting the conditions required for such access.

Causing damage to the physical or logical systems of the Web Space, its suppliers, or third parties.

Introducing or spreading computer viruses or any other physical or logical systems on the network that are likely to cause damage to the physical or logical systems of Meigas de Brigantia, suppliers, or third parties.

Attempting to access, use and/or manipulate data of Meigas de Brigantia, third-party providers, and other Users.

Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the content, unless authorized by the holder of the corresponding rights or it is legally permitted.

Deleting, hiding or manipulating notes on intellectual or industrial property rights and other identifying data of the rights of Meigas de Brigantia or third parties incorporated into the contents, as well as technical protection devices or any information mechanisms that may be inserted into the contents.

Obtaining and attempting to obtain the content by using means or procedures other than those which, depending on the case, have been made available for this purpose or have been expressly indicated on the web pages where the contents are found or, in general, those normally used on the Internet because they do not entail a risk of damage or disabling of the Web Space and/or contents.

In particular, and merely by way of indication and not exhaustively, the User agrees not to transmit, distribute or make available to third parties: information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

  • In any way contravenes, disparages or attacks fundamental rights and public liberties constitutionally recognized, in International Treaties and the rest of current legislation.
  • Induces, incites or promotes criminal, denigrating, defamatory, violent actions or, in general, those contrary to law, morals, generally accepted good customs, or public order.
  • Induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age, or condition.
  • Incorporates, makes available, or allows access to criminal, violent, offensive, harmful, degrading products, elements, messages and/or services or, in general, those contrary to law, morals and generally accepted good customs, or public order.
  • Induces or may induce an unacceptable state of anxiety or fear.
  • Induces or incites involvement in dangerous, risky or harmful practices to health and psychological balance.
  • It is protected by legislation on intellectual or industrial protection belonging to Meigas de Brigantia or third parties without authorized use having been permitted.
  • Is contrary to honor, personal and family privacy, or the person's own image.
  • Constitutes any type of advertising.
  • Includes any type of virus or program that prevents the normal operation of the Web Space.

If you are provided with a password to access some of the services and/or content of the Web Space, you are obliged to use it diligently, keeping it secret at all times. Consequently, you will be responsible for its proper custody and confidentiality, promising not to hand it over to third parties, temporarily or permanently, nor allow access to the mentioned services and/or content by unauthorized persons. Similarly, you are obligated to notify Meigas de Brigantia of any event that may lead to unauthorized use of your password, such as, by way of example, its theft, loss or unauthorized access, in order to proceed to its immediate cancellation. Consequently, until the previous notification is made, Meigas de Brigantia will be exempt from any liability that may arise from the misuse of your password, leaving you responsible for any unlawful use of the content and/or services of the Web Space by any illegitimate third party. If you negligently or willfully breach any of the obligations established in these General Conditions of Use, you will respond for all damages that such breach may cause to Meigas de Brigantia.

6. Responsibilities

Continuous access, correct display, downloading or utility of the elements and information contained on the web cannot be guaranteed and may be impeded, hindered, or interrupted by factors or circumstances out of our control. We are not responsible for any decisions taken as a result of access to the contents or information offered.

The service may be interrupted, or the relationship with the User resolved immediately, if it is detected that a use of the Web Space, or any of the services offered therein, is contrary to these General Conditions of Use. We are not responsible for damages, losses, claims or expenses derived from the use of the Web Space.

We will only be responsible for removing, as soon as possible, contents that could generate such damage, provided it is notified. In particular, we will not be liable for the damages that could result from, among others:

  • Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blocks or disconnections in the operation of the electronic system, caused by deficiencies, overloads, and errors in the telecommunication lines and networks, or by any other cause beyond the control of Meigas de Brigantia.
  • Illegitimate intromissions through the use of malicious programs of any kind and through any communication means, such as computer viruses or any other.
  • Improper or inappropriate abuse of the Web Space.
  • Security or navigation errors caused by a malfunction of the browser or by the use of outdated versions of it. The administrator of the web space reserves the right to withdraw, totally or partially, any content or information present in the Web Space.

Meigas de Brigantia excludes any responsibility for damages of any nature that could be due to the misuse of services freely available for use by Web Space Users. Likewise, it is exonerated from any liability for content and information that may be received as a result of data collection forms, these only being for the provision of inquiry and doubt services. On the other hand, in case of causing damages for an unlawful or incorrect use of these services, the User may be claimed for the damages or losses caused.

You will hold Meigas de Brigantia harmless from any damages arising from claims, actions or demands from third parties as a result of your access or use of the Web Space. Likewise, you agree to indemnify against any damages deriving from your use of "robots", "spiders", "crawlers" or similar tools used for the purpose of collecting or extracting data or any other action on your part that imposes an unreasonable burden on the operation of the Web Space.

7. Hyperlinks

The User undertakes not to reproduce in any way, not even through a hyperlink, the Web Space, as well as any of its contents, without express written authorization from the data controller.

The Web Space may include links to other web spaces managed by third parties, in order to facilitate the User's access to the information of collaborating and/or sponsoring companies. Consequently, Meigas de Brigantia is not responsible for the content of those web spaces, nor does it stand in a position of guarantor and/or provider of the services and/or information that may be offered to third parties through third-party links.

The User is granted a limited, revocable, and non-exclusive right to create links to the main page of the Web Space exclusively for private and non-commercial use. Web Spaces that include a link to our Web Space:

  1. may not misrepresent their relationship or claim that such link has been authorized, nor include brands, denominations, commercial names, logos, or other distinctive signs belonging to Meigas de Brigantia.
  2. may not include content that may be considered tasteless, obscene, offensive, controversial, inciting violence or discrimination based on sex, race, or religion, contrary to public order or illegal;
  3. may not link to any page of the Web Space other than the main page;
  4. must link to the very address of the Web Space, without allowing the linking web space to reproduce the Web Space as part of its website or within one of its "frames" or to create a "browser" on any of the pages of the Web Space.

Meigas de Brigantia may request, at any time, that you remove any link to the Web Space, after which you must immediately proceed to its elimination.

Meigas de Brigantia cannot control the information, content, products, or services provided by other web spaces that have established links to the Web Space.

8. Data Protection

To use some of the Services, the User must first provide certain personal data. Meigas de Brigantia will automatically process these data and apply the corresponding security measures, all in compliance with the GDPR, LOPDGDD, and LSSI. The User can access the policy followed regarding the processing of personal data, as well as the establishment of the previously stated purposes, in the conditions defined in the Privacy Policy.

9. Cookies

Meigas de Brigantia reserves the right to use "cookie" technology on the Web Space, to recognize you as a frequent User and personalize your use of the Web Space by pre-selecting your language, or more desired or specific content.

Cookies collect the user's IP address, with Google being responsible for processing this information.

Cookies are files sent to a browser, by means of a Web server, to record the User's navigation on the Web Space, when the User permits their reception. 10. Declarations and Guarantees

In general, the contents and services offered in the Web Space are purely informative. Consequently, by offering them, no guarantee or declaration of any kind is granted regarding the contents and services offered in the Web Space, including, by way of example, guarantees of legality, reliability, usefulness, truthfulness, accuracy, or merchantability, except to the extent that by law such declarations and guarantees cannot be excluded.

11. Force Majeure

Meigas de Brigantia will not be liable at all in case of inability to provide service if this is due to prolonged interruptions of the electrical supply, telecommunications lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all situations of force majeure or acts of God.

12. Resolution of Controversies. Applicable Law and Jurisdiction

These General Conditions of Use, as well as the use of the Web Space, shall be governed by Spanish law. To resolve any dispute, the parties will submit to the Courts and Tribunals of the registered office of the Website Owner.

In the event that any stipulation of these General Conditions of Use proves unenforceable or null under applicable law or as a consequence of a judicial or administrative resolution, such unenforceability or nullity shall not render these General Conditions of Use unenforceable or null as a whole. In such cases, Meigas de Brigantia will proceed to modify or replace that stipulation with another that is valid and enforceable and that, as far as possible, achieves the objective and intent reflected in the original stipulation.
